Service Agreement

1. Scope of affiliated services

Affiliated Services are the professional support services the Service Provider makes available to the Applicant. Depending on the service purchased, these may include:

• Regulator account set-up and application support (for example NMC, HCPC or equivalent).
• Examination and assessment preparation support.
• Visa application preparation, review and submission support.
• Travel, flight and accommodation coordination support.
• General relocation and onboarding support.

2. Commencement

The Agreement commences on the date the service fee is received by the Service Provider. That date is the Effective Date.

3. Term and termination

The Agreement continues until the purchased services are completed, unless terminated earlier under this clause.

The Service Provider may terminate on 10 working days' written notice where the Applicant materially breaches this Agreement and does not remedy the breach after written notice. The Applicant may terminate by giving 15 days' written notice.

Except where the refund policy in the Visa Consultancy Disclaimer and Terms of Service applies, fees paid are non-refundable regardless of who terminates the Agreement or the completion status of the services.

4. Applicant obligations

The Applicant must supply accurate, complete and truthful information and documentation, and meet any deadlines set by the Service Provider.

The Service Provider is not liable for any consequence arising from concealment or misstatement of material facts by the Applicant, who remains solely responsible for the direct and indirect consequences of any such concealment.

The Applicant must comply with all laws and regulations relevant to the services.

5. Fees and payment

The fee for each service is the price shown at the point of purchase. Fees cover professional services only and exclude government, regulator, Home Office, courier, translation and third-party charges.

Where the work required goes materially beyond the scope purchased, the Service Provider will inform the Applicant in advance and may raise an additional fee for that work.

Where payment is due and not made, the Service Provider may give written notice of default. If the default is not cured within 10 days, services may be suspended and the Agreement terminated.

6. Confidentiality and data

Each party shall keep confidential the non-public information of the other. Personal data is processed in accordance with the Data Protection Consent Declaration and applicable data protection law.

7. Limitation of liability

The Service Provider provides professional assistance only and cannot guarantee any outcome, decision, timescale or approval by any regulator, employer, embassy or government authority.

To the fullest extent permitted by law, the Service Provider's total liability under this Agreement is limited to the fee paid for the service in question. The Service Provider is not liable for indirect or consequential loss, including loss of earnings or opportunity.

8. General

This Agreement is the entire agreement between the parties for the services purchased and supersedes prior discussions. If any clause is held unenforceable, the remainder continues in force. Notices may be given by email to the addresses held on file.

This Agreement is governed by the laws of India, and the parties submit to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, save where mandatory consumer law provides otherwise.
